1. Introduction
These Terms and Conditions of Sale (“Terms”) apply to all sales of digital products (the “Products”) made by Apex Online International KFT, a limited liability company incorporated under Hungarian law and registered with the Hungarian Trade Register (the “Seller”), through its website tiger-sounds.com (the “Website”). By placing an order on the Website, you accept these Terms.
2. Products
The Products sold by the Seller on the Website are downloadable digital products, including:
- Pendora VST (and its different editions: Lite, Full, Ultimate) — virtual instrument in the form of a preset bank
- Pegasus VST (sold via the sister brand Cosmos Instruments) — virtual instrument
- Drum kits, MIDI packs, sample packs — royalty-free sound libraries
- Any extension, update or complementary product offered on the Website
Each Product is described on its corresponding page on the Website.
3. Order
To place an order, the Customer selects the Product of their choice and finalizes the purchase directly on the order page. Before final validation, the Customer can review the order details and total price, and correct any errors.
4. Access to Digital Products
Access to downloadable Products is provided via the Website immediately after payment validation, through:
- The order confirmation email, containing the license key and download links
- The Customer’s member area accessible at
tiger-sounds.com/account/, where all purchased files are available for life
Should the Website cease its activity or change platform, the Seller commits to providing the Customer with new download links by email.
5. Pricing
Product prices are displayed on the Website in euros (€) or US dollars ($), depending on the currency selected by the Customer. Prices may be modified at any time by the Seller; the prices displayed at the time of order are the only ones applicable to that order.
6. Payment
The full price is due upon order. The Customer can pay by credit card (Visa, Mastercard, American Express) or by any other payment method indicated on the Website.
Payments are secured and processed by our provider Stripe. No credit card information is stored on the Website.
7. Refund Guarantee
Given the digital nature of the Products, the Seller does not offer a default refund guarantee beyond what is provided by applicable law (see Article 12 — Right of Withdrawal).
8. No Promise of Results
The Products sold are digital tools (sound banks, plugins, samples) intended for musical use. The Seller does not guarantee any commercial, artistic, or financial result related to the use of the Products. The Customer remains solely responsible for the quality of their music production and any commercial exploitation thereof.
9. Affiliation
The Seller may offer an affiliate program allowing Customers or partners to promote the Products in exchange for commissions. Commissions are paid on the 10th of each month for sales made with a minimum delay of 14 days between the receipt of the affiliated sale and the commission payment.
In case of refund of a Customer who purchased via an affiliate link, the commission is cancelled.
Self-affiliation is prohibited: in case of purchase by a Customer using their own affiliate link, the commission is cancelled and the Customer is not eligible for any refund guarantees.
10. Liability
Apex Online International KFT cannot be held liable for any inconvenience or damage inherent to the use of the internet network, including temporary Website unavailability or delay in the delivery of download links.
The Seller’s liability is limited to the amount of the Product purchased by the Customer.
11. Intellectual Property Rights
All Products offered on the Website are the exclusive property of Apex Online International KFT. The reproduction, redistribution, resale, public sharing, or exploitation of the Products, in whole or in part, without the prior written consent of the Seller is strictly prohibited and constitutes infringement punishable by law.
License granted to the Customer:
- The Customer may use the sounds, presets, and samples of the Products in their own musical compositions, including for commercial purposes (royalty-free)
- The Customer may not redistribute, share, sell, or make public the source files of the Products (.zip, .exe, isolated presets)
- The Pendora license key is strictly personal and nominative; any sharing with a third party will result in immediate deactivation without refund
12. Right of Withdrawal
In accordance with Directive 2011/83/EU on consumer rights and its transposition into Hungarian law, any Customer residing in a European Union country has a 14-day right of withdrawal from the order date.
However, this right of withdrawal does not apply in the following cases (Article 16 (m) of the Directive):
- When the Customer has downloaded the digital Product
- When the Customer has logged in to
tiger-sounds.com/account/and accessed their files - When the Customer has installed the plugin on their computer or used the license key
By accessing the platform and downloading the Products, the Customer expressly waives their right of withdrawal, in accordance with Hungarian and European law applicable to digital content.
For business customers (B2B), the right of withdrawal does not apply.
To exercise the right of withdrawal when the above conditions are met, the Customer must email contact@tiger-sounds.com within 14 days of the order, specifying their order number.
13. Personal Data
Personal data collected as part of the order (email, name, billing address) is processed in accordance with the Website’s Privacy Policy and the General Data Protection Regulation (GDPR), as applicable in Hungary via Act CXII of 2011 on the Right to Informational Self-Determination and on Freedom of Information (Infotv.).
The Seller does not sell or share Customer data with third parties for commercial purposes.
14. Governing Law and Jurisdiction
These Terms are governed by Hungarian law, subject to the application of the mandatory consumer protection provisions of the law of the consumer’s country of habitual residence, in accordance with Regulation (EC) No 593/2008 (Rome I).
If one or more provisions of the Terms are held to be invalid or declared as such pursuant to a law, regulation, or final decision of a competent jurisdiction, the other provisions remain in full force and effect.
In the event of a dispute between the Customer and Apex Online International KFT regarding the interpretation or execution of the Terms, the parties will endeavor to resolve the dispute amicably. To this end, the Seller provides email support at contact@tiger-sounds.com; any request made via WhatsApp, Discord, social media, or other platforms will not be considered.
Failing an amicable agreement, the dispute will be submitted to the competent courts of Hungary.
15. Exclusion for Inappropriate Behavior
The Seller reserves the right to immediately and without notice exclude any Customer from access to the Products, member area, community, or any other service offered, in case of inappropriate behavior including:
- Harassment, insults, or threats towards other members or the team
- Unauthorized sharing of Product content or violation of intellectual property rights
- Spam, unsolicited promotion, or unauthorized commercial activities
- Fraudulent behavior or attempts to bypass payment systems
- Use of Products in illegal, hateful, or inhumane contexts
- Any other behavior affecting the proper functioning of the Website or its integrity
Exclusion does not give rise to any refund.
